Public Liability Insurance

It's easy for independent contractors to think of themselves as individuals rather than businesses and assume that they don't need Public Liability insurance. But this is a false assumption. No matter what your profession may be, whether you're a graphic designer, a management consultant, an engineer, an IT contractor, or even if you're self-employed, you might very well need Public Liability and Professional Indemnity insurance.

As a private contractor, you may have already noticed that potential clients will often insist on having Public Liability and Professional Indemnity insurance. A growing number of organisations across both the public and private sectors are simply not willing to work with any supplier who does not have Public and Products Liability Insurance protection in place.

Our Combined Public & Products Liability cover can only be purchased together with our Professional Indemnity policy.

What is Public Liability insurance?

Every business, no matter the size, has a duty of care to the general public. If a claim is made and your business caused physical loss, damage or injury to a person or their property, the courts in Australia may award costs and damages against you. Where a business is the manufacturer or distributor of a product, that business may also be liable for damage caused by the products that it sells.

You may well be thinking: how could it happen to you? Well, if you ever visit a client's premises or they visit your office, it could happen very easily. As a contractor, if you're visiting them, no matter how careful you are, there is always the risk that you might accidentally damage something valuable. Even worse, if you're working from their premises or using their equipment, someone could suffer an injury caused by you and you wouldn't be covered by the client's Public Liability insurance.

Please bear in mind, whilst damage to property may only amount to hundreds of dollars, an injury that results in hospital treatment or the client having to be absent from their work for an extended period of time could result in a claim for thousands of dollars. A client can claim for a lot more if the accident were to lead to someone being permanently incapacitated. Not to mention, there is all the associated legal costs for which you could also end up liable.
